                The Daily Record Website User Agreement
                                
The Daily Record website, http://www.dailyrecord.us, provides access to its database of public records, public notices and other content on a fee basis. 

In order to access said database, users must agree to all of the following terms and conditions. If you agree to the terms and conditions below, you should select "Agree" at the end of the contract to acknowledge that you have agreed. Only by selecting "Agree" will you be able to access and use the databases.:

1) I agree that I am liable for all payments charged to my account by me or anyone using my "Login ID" and "Password" to access The Daily Record website. 

2) I agree that the accuracy of responses returned from my searches are contingent on my typing search parameters using correct spellings. 

3) I agree to use the data I obtain from The Daily Record website only for legitimate, legal purposes. 

4) I UNDERSTAND THE DAILY RECORD WEBSITE DATABASE IS PROVIDED "AS IS" "WHERE IS" AND THE DAILY RECORD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, NON-INFRINGEMENT OR ANY OTHER WARRANTY, CONDITION, GUARANTY, OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION CONTAINED HEREIN OR PROVIDED BY THE DAILY RECORD WEBSITE. 

5) I agree not to use the data contained in The Daily Record website as the sole basis for approving or denying credit to a person or company. 

6) The Daily Record website will charge me a standard recurring monthly fee payable in advance for using the database as well as additional fees as follows: Fee to download a list of names from data contained in one of the "List Builder" databases and fee to download any reports or special add on features on the site. Subscribing to the website includes a subscription to the print edition of The Daily Record. I can cancel my account at any time by written notice faxed, e-mailed or mailed certified mail return receipt requested to The Daily Record website, Attention: Customer Service, P.O. Box 3595, Little Rock, AR 72203, fax: (501) 372-3048, e-mail: customerservice@dailydata.com provided, however, I will remain liable for all charges accrued up to that time, including full monthly charges for the month for which I discontinued service. The Daily Record website reserves the right to change its fees at any time for any reason. I understand that the monthly fee entitles me to perform unlimited Name Searches and Address Searches on public records at no extra cost, unless my search volume becomes excessive based on the average historical search volume, at which point a usage fee may be applied. I further understand that I am responsible for any expenses incurred by The Daily Record for the collection of charges incurred by my use of the site, including reasonable attorney's fees.  

7) I agree to indemnify and hold harmless The Daily Record Inc. and its officers, directors and employees for any claim for damages resulting from information derived from searches I performed on its web site. I agree that The Daily Record is not liable for any monetary damages resulting from information derived from searches on its web site. 

8) I UNDERSTAND AND AGREE THAT MY USE OF THE DAILY RECORD WEBSITE DATABASE IS ENTIRELY AT MY SOLE RISK. THE DAILY RECORD WEBSITE WILL NOT BE RESPONSIBLE TO ME OR ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES I MAY INCUR IN CONNECTION WITH ITS SYSTEM, MY USE THEREOF OR ANY OF THE DATA OR OTHER MATERIALS TRANSMITTED THROUGH OR RESIDING ON ITS SYSTEM, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF THE DAILY RECORD WEBSITE HAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. 

9) I understand that if I choose to sign up only for a subscription to the print edition of The Daily Record, certain terms and conditions related exclusively to Web site use, Web site features, and Web site searches do not apply to me.

We try to the best of our ability to maintain the highest level of security regarding transfer of credit card information. If you have concerns regarding the electronic transfer of your information, print this form. Complete all information and fax to The Daily Record at (501) 372-3048. Your account will be activated within twenty-four hours after receipt. Refunds are given up to 30 days after a subscription is ordered and exclude issues received. No refund after 30 days for print or online versions.
