Arkansas Land & Equipment, LLC, executed, acknowledged, and delivered to BancorpSouth Bank (the “Bank”) the following: (1)  a Real Estate Mortgage dated May 26, 2010, and filed for record in the Office of the Circuit Clerk and Ex-Officio Recorder of Saline County, Arkansas, on June 1, 2010, in Book 10 at Page 42838, as modified by that Mortgage Modification, Correction and Affirmation Agreement dated November 9, 2015, and filed for record in Saline County, Arkansas, on December 1, 2015, and labeled Instrument No. 2015-080339. (2)  a Real Estate Mortgage dated December 20, 2010, and filed for record in the Office of the Circuit Clerk and Ex-Officio Recorder of Saline County, Arkansas, on January 27, 2011, in Book 2011 at Page 7083, as modified by that Mortgage Modification and Affirmation Agreement dated November 9, 2015, and filed for record in Saline County, Arkansas, on December 1, 2015, and labeled Instrument No. 2015-080340. The indebtedness secured by the above-referenced mortgages granted by Arkansas Land & Equipment, LLC was not paid when due and is in default.
