NOTICE IS HEREBY GIVEN that on June 13, 2017, at or about 11:00 a.m., the following real property and all improvements and fixtures located thereon will be sold at the Pulaski County Courthouse located in Little Rock, Arkansas, at the location where statutory foreclosure sales are customarily advertised and conducted, to the highest bidder for cash: A part of Blocks 19 and 20, John L. Atkins School Subdivision of Part of Spanish Grant #2431 and of Part of Section 32, Township 2 North, Range 11 West, now in the City of North Little Rock, Pulaski County, Arkansas, more particularly described as follows: From the Southwest corner of said Block 20, run Northerly along the East line of Middle Street 271.5 feet to a stake set as the point of beginning of the description of the property hereby conveyed from the point of beginning thus established run Easterly parallel with School Street 137.2 feet to a stake set; thence Northerly parallel with Middle Street 50 feet to a stake set; thence Westerly parallel with School Street 137.2 feet to a stake set on the East line of Middle Street; thence Southerly along said East line 50 feet to point of beginning, such real property having the address of 220 Middle Street, North Little Rock, Arkansas 72117 (hereinafter referred to as the “Property”). On July 11, 2007, James McDaniel, an unmarried person, executed a Mortgage (hereinafter referred to as such) in favor of Summit Bank, which Mortgage was filed of record on July 18, 2007, as Instrument No. 2007056043, in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, whereby James McDaniel, an unmarried person, conveyed the Property to Summit Bank. The terms of the Mortgage were modified, renewed, and/or extended by virtue of certain Modifications of Mortgage (hereinafter referred to as such) executed by James McDaniel, an unmarried person, dated February 15, 2008, and February 15, 2013, which Modifications of Mortgage were filed of record on February 29, 2008, and April 3, 2013, respectively, as Instrument Nos. 2008013862 and 2013024749, respectively, in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas. Bank of the Ozarks, as successor by merger to Summit Bank, is now the holder in due course of the Mortgage, the Modifications of Mortgage, and the Promissory Note which is secured by the Mortgage, as modified, renewed, and/or extended by the Modifications of Mortgage. James McDaniel, an unmarried person, has defaulted in the monthly payments owed to Bank of the Ozarks under the Promissory Note which is secured by the Mortgage, as modified, renewed, and/or extended by the Modifications of Mortgage, and is more than two hundred (200) days past due in payments to Bank of the Ozarks. The undersigned is the attorney for Bank of the Ozarks, the mortgagee, and is acting on behalf and with the consent and authority of the mortgagee, which is exercising its power of sale under Ark. Code Ann. § 18-50-115 (West 2004), which implies a power of sale in every mortgage of real property situated in this state that is duly acknowledged and recorded. The sale will extinguish all rights of any party claiming an interest in the Property, including existing lienholders, current or previous owners of the property, or tenants.
