NOTICE IS HEREBY GIVEN that on December 12, 2019, at or about 11:00 a.m., the following real property and all improvements and fixtures located thereon will be sold at the Faulkner County Courthouse located in Conway, Arkansas, at the location where statutory foreclosure sales are customarily advertised and conducted, to the highest bidder for cash: Tract 1: Lot 53, Stratford Place Subdivision to the City of Conway, Arkansas, Faulkner County, as shown on Plat Book 1, Page 31, to the Faulkner County Records, such real property having the address of 1445 Arden Lane, Conway, Arkansas 72034; Tract 2: Lot 8, Block 3, Con-Ark I-40 Commercial Subdivision to the City of Conway, Arkansas, as shown on the Re-Plat of Blocks 2, 3, and 4, Con-Ark I-40 Commercial Subdivision, recorded in Plat Book F, Page 58, records of Faulkner County, Arkansas, such real property having the address of 1306 Collier Drive, Conway, Arkansas 72034; and Tract 3: Lot 6, Block 3, Con-Ark I-40 Commercial Subdivision to the City of Conway, Faulkner County, Arkansas, as shown on the Re-Plat of Blocks 2, 3, and 4, Con-Ark I-40 Commercial Subdivision, recorded in Plat Book F, Page 58, records of Faulkner County, Arkansas, such real property having the address of 1310 Collier Drive, Conway, Arkansas 72034 (Tract 1, Tract 2, and Tract 3 shall be hereinafter referred to collectively as the “Property”). On December 14, 2011, Darrell F. Thomas and Tiffani Thomas, husband and wife, executed a Mortgage (hereinafter referred to as such) in favor of Summit Bank, which Mortgage was filed of record on December 15, 2011, as Document No. 2011-19968, in the office of the Circuit Clerk and Ex-Officio Recorder of Faulkner County, Arkansas, whereby Darrell F. Thomas and Tiffani Thomas, husband and wife, conveyed the Property to Summit Bank. Bank OZK, formerly known as Bank of the Ozarks, as successor by merger to Summit Bank (hereinafter referred to as “Bank OZK”), is now the holder in due course of the Mortgage and the Promissory Note it secures. The terms of the Mortgage were modified, renewed, and/or extended by virtue of that certain Modification of Mortgage (hereinafter referred to as such) executed by Darrell F. Thomas and Tiffani Thomas, husband and wife, in favor of Bank OZK dated July 28, 2017, which Modification of Mortgage was filed of record on August 3, 2017, as Instrument No. 201712084, in the office of the Circuit Clerk and Ex-Officio Recorder of Faulkner County, Arkansas. Darrell F. Thomas and Tiffani Thomas, husband and wife, have defaulted in the monthly payments owed to Bank OZK under the Promissory Note which is secured by the Mortgage, as modified, renewed, and/or extended by the Modification of Mortgage, and are more than six hundred sixty (660) days past due in payments to Bank OZK. The undersigned is the attorney for Bank OZK, the mortgagee, and is acting on behalf and with the consent and authority of the mortgagee, which is exercising its power of sale under Ark. Code Ann. § 18-50-115 (West 2019), which implies a power of sale in every mortgage of real property situated in this state that is duly acknowledged and recorded. The sale will extinguish all rights of any party claiming an interest in the Property, including existing lienholders, current or previous owners of the property, or tenants.
