NOTICE OF DRAFT PERMIT DECISION BY THE ARKANSAS DEPARTMENT OF ENVIRONMENTAL QUALITY In accordance with provisions of Arkansas Statutes, 8-4-203, public notice is hereby given that as of January 21, 2011, the Mining Program of the Arkansas Department of Environmental Quality (ADEQ) announces its draft decision to issue a modification to an existing open-cut mining permit as requested by Central Farms, LLC, 5317 John F. Kennedy Blvd, North Little Rock, AR 72120, for a mining facility located near Mayflower in Faulkner County, Arkansas. Central Farms, LLC has submitted the required documentation for the expansion of an existing open-cut mining permit (0765-MN) located off of Highway 365 in Sections 1 and 2, Township 3 North, Ranges 13 and 14 West in Faulkner County. The site will be mined for clay, shale and gravel with a total estimated affected area of approximately thirty (30) acres. Any interested person may submit written comments concerning the technical merits of the ADEQ's draft decision within 30 days of the publication of this notice. Any interested person may submit a request for a public hearing on the draft permit decision within 30 days of the publication of this notice. The decision on whether to schedule a public hearing is at the ADEQ’s discretion. If a hearing is scheduled, first class mail notice will be provided to the permit applicant and to all persons who submitted a request for a public hearing and who provided public comments on the record. Written comments concerning ADEQ's draft decision should be sent to: James F. Stephens, Chief Geologist, Arkansas Department of Environmental Quality, 5301 Northshore Drive, North Little Rock, AR 72118-5317 or by email to stephens@adeq.state.ar.us. Additional information regarding the draft decision, including copies of the permit application and documents concerning the review process by the ADEQ staff, can be made available for inspection and copying by contacting ADEQ's at the above address. There will be a charge to cover photocopying costs. A final, written decision on this permit application will be issued by ADEQ after the close of the 30-day public comment period or after a public hearing if one is held. The final decision will include a response to each issue raised during the public comment period for this proposal, and will include an explanation of the rationale for any technical requirements or standards involved in making the final decision. Any person with legal standing in this matter may appeal the ADEQ's final decision to the Arkansas Pollution Control and Ecology Commission. Appeals must be in writing, must be filed within 30 days of the ADEQ's final decision, and must conform to all the requirements set forth in Regulation No. 8.
