ORDINANCE NO. 22,194-AN ORDINANCE TO ABANDON A FORTY (40)-FOOT WIDE UTILITY AND DRAINAGE EASEMENT LOCATED ALONG THE EAST SIDE OF WOODLANDS TRAIL, WITHIN THE WOODLANDS PARK SUBDIVISION (UNRECORDED), IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

WHEREAS, a request was made by Woodlands Park of Little Rock, LLC, to abandon approximately 500 feet of a forty (40)-foot wide Utility and Drainage Easement (dedicated by instrument No. 2009042560 with the abandonment of Asbury Road) located along the east side of Woodlands Trail, within the Woodlands Park Subdivision (unrecorded), Little Rock, Arkansas, under the City’s General Police Power Authority pursuant to Ark. Code Ann. § 14-54-104; and,

WHEREAS, the Woodlands Park Subdivision (unrecorded) is a forty-five (45)-lot Single-Family Subdivision located on approximately 9.8 acres of R-2, Single-Family District, zoned property; and, 

WHEREAS, all of the public utility companies approved the proposed Utility and Drainage Easement abandonment; and, 

WHEREAS, abandoning this forty (40)-foot wide Utility and Drainage Easement will have no adverse impact on the public welfare and safety.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.

Section 1. The Board of Directors hereby releases, vacates, and abandons a forty (40)-foot wide Utility and Drainage Easement located along the east side of Woodlands Trail, within the Woodlands Park Subdivision (unrecorded), Little Rock, Pulaski County, Arkansas, being more particularly described as follows: G-24-061: DESCRIBED AS BEING A PORTION OF THE SOUTH 2.2649 ACRES OF TRACT 11, THE WEST 1/2 OF TRACT 13, THE WEST 1/2 OF TRACT 16 AND 2.30 ACRES BEING A PART OF TRACT 10 AND TRACT 14 OF ASBURY ACRES SUBDIVISION, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF TRACT 11, ASBURY ACRES SUBDIVISION; THENCE S01°47'37"W, ALONG THE WEST LINE OF TAYLOR PARK SUBDIVISION, A DISTANCE OF 339.09'; THENCE N87°48'36"W-339.15'; THENCE N87°56'09"W-4.50' TO THE POINT OF BEGINNING OF SAID EASEMENT ABANDONMENT; THENCE S02°56'09"E-15.00'; THENCE S01°49'38"W-496.84'; THENCE S34°07'26"W-14.35'; THENCE N55°52'34"W-38.25'; THENCE N01°49'38"E-503.75'; THENCE S87°56'09"E-15.50' BACK TO THE POINT OF BEGINNING. CONTAINING 20,218.45 S.F. / 0.4641 ACRES, MORE OR LESS.

Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the Real Estate Records of the Recorder of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas.

Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part of the ordinance. 

Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
