RESOLUTION NO. 15,822-A RESOLUTION TO EXTEND THE THIRD STREET TEMPORARY ENTERTAINMENT DISTRICT, FOR APPROXIMATELY THIRTEEN (13) CONSECUTIVE WEEKS STARTING ON NOVEMBER 15, 2022, AND ENDING ON FEBRUARY 14, 2023; AND FOR OTHER PURPOSES. 

WHEREAS, on July 23, 2019, the Board of Directors of the City of Little Rock, Arkansas, passed Little Rock, Ark., Ordinance No. 21,761, as amended, which permitted the creation of a Temporary Entertainment District pursuant to Arkansas State Law and City Ordinance; and,

WHEREAS, the City Board of Directors has determined the creation of a Temporary Entertainment District as proposed by Ordinance No. 21,761 as amended is appropriate as recommended by the Planning & Development Department. 

WHEREAS, the City Board of Directors adopted in Resolution 15,496 (July 6, 2021), the Third Street Entertainment District as a Temporary Entertainment District providing days and hours of operation to be July 7, 2021, and October 6, 2021, from 11:00 AM to 10:00 PM; and,

WHEREAS, the City Board of Directors adopted in Resolution 15,556 (November 2, 2021), the Third Street Entertainment District as a Temporary Entertainment District providing days and hours of operation to be November 3, 2021, and January 31, 2022, from 11:00 AM to 10:00 PM; and,

WHEREAS, the City Board of Directors adopted in Resolution 15,616 (February 15, 2022), the Third Street Entertainment District as a Temporary Entertainment District for approximately thirteen (13) weeks starting on February 15, 2022, and ending on May 17, 2022, Sunday through Saturday from 11:00 AM to 10:00 PM; and,

WHEREAS, on October 28, 2022, the City of Little Rock has received an application to extend the Temporary Entertainment District for approximately thirteen (13) weeks starting on November 15, 2022, and ending on February 14, 2023, Sunday through Saturday from 11:00 AM until 10:00 PM.  

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. 

Section 1. The Third Street Temporary Entertainment District is hereby extended by the City of Little Rock as a Temporary Entertainment District on Tuesday, November 15, 2022, and subject to Ordinance No. 21,761 as amended and its defined terms.

Section 2. Boundaries. The Third Street Temporary Entertainment District boundaries are particularly described as 2nd Street and River Market Avenue to Cumberland Street on the north to 4th Street and River Market Avenue to Cumberland Street at the south.

Section 3. Timeframe. The Third Temporary Entertainment District shall be designated as a Temporary Entertainment District upon the adoption of this resolution and shall expire after approximately thirteen (13) consecutive weeks, starting on November 15, 2022, and ending on February 14, 2023. The hours of operation for the Third Street Temporary Entertainment District are from 11:00 AM - 10:00 PM, Sunday through Saturday. The City reserves the right to amend boundaries and hours of operation at its sole discretion. 

Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. 

Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
