ORDINANCE NO. 21,612 AN ORDINANCE FOR THE ABANDONMENT OF A PORTION OF THE FIFTY (50)-FOOT WIDE NORTH KATILLUS ROAD RIGHT-OF-WAY LOCATED IN THE NE 1/4, SW 1/4, SECTION 13, T-2-N, R-14-W, LITTLE ROCK, PULASKI COUNTY, ARKANSAS; (G-23-469); AND FOR OTHER PURPOSES. WHEREAS, the City of Little Rock, Arkansas (the “City”) maintains a fifty (50)-foot wide Katillus Road right-of-way located in the NE 1/4, SW 1/4, Section 13, T-2-N, R-14-W, Little Rock, Pulaski County, Arkansas; and,  WHEREAS, the Little Rock School District (“LRSD”) is the abutting property owner and has recently developed a sports field for the new Pinnacle View Middle School campus located on Ranch Drive; and, WHEREAS, LRSD requests the City abandon a portion of the fifty (50)-foot wide Katillus Road right-of-way located in the NE 1/4, SW 1/4, Section 13, T-2-N, R-14-W, Little Rock, Pulaski County, Arkansas; and,  WHEREAS, the right-of-way serves no public purpose and is located entirely within the Little Rock School District Pinnacle View School sports field site; and,  WHEREAS, all utilities have voiced no objection to the abandonment. NOW, THEREFORE, BE IT ORDANDED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Planning Commission first reviewed and conditionally approved the development of a sports field at its October 6, 2016, meeting, and there were no objectors present. On May 31, 2018, a revision to conditional approval was requested to provide lighting to the sports field, at which time it was discovered that LRSD had not pursued abandonment of the Katillus Road right-of-way. Section 2. A public hearing concerning the abandonment of all that part of the North Katillus Road right-of-way located in the NE 1/4, SW 1/4, Section 13, T-2-N, R-14-W, Little Rock, Pulaski County, Arkansas, was held by the Board of Directors at its meeting on August 7, 2018, at Little Rock City Hall, 500 West Markham Street, Little Rock, Arkansas. All interested persons had the opportunity to be heard concerning the abandonment of the easements and covenants. Section 3. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this ordinance are hereby repealed to the extent of such conflict.
