ORDINANCE NO. 21,770 AN ORDINANCE TO ACCEPT THE AluChem ANNEXATION (A-335), TO ADD CERTAIN LANDS TO THE CITY OF LITTLE ROCK, ARKANSAS; TO APPROVE A PLANNED ZONING development AND ESTABLISH A PLANNED INDUSTRIAl DISTRICT Titled ALUCHEM short-form pId, located at 10500 ARCH STREET PIKE (z-9432), little rock, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. WHEREAS, a petition for voluntary annexation (the “Petition”) was filed with the County Clerk of Pulaski County, Arkansas, for 100% owner praying that said lands be annexed to and made part of the City of Little Rock, Arkansas; and, WHEREAS, the County Court of Pulaski County, Arkansas, found that the Petition was correct as to form as required of Arkansas Code 14-40-609; and, WHEREAS, the Pulaski County Judge has signed an Annexation Order for the site requesting annexation (filed June 17, 2019); and, WHEREAS, an accurate map of said lands has been filed with and made a part of said Petition; and, WHEREAS, all things pertaining thereto have been done in the manner prescribed by law and that said lands should be annexed to and made part of the City of Little Rock. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The following described territory contiguous and adjoining the City of Little Rock, Arkansas, is accepted as annexed to and made a part of the City of Little Rock, Pulaski County, Arkansas, to wit: A-335: BEING A PART OF THE SE1/4, SE1/4, SECTION 5 AND ALSO A PART OF THE NE 1/4, NE 1/4, SECTION 8, T-1-S, R-12-W, PULASKI COUNTY, ARKANSAS MORE PARTICULARLY DESCRIBED AS BEGINNING AT THE NORTHEAST CORNER OF THE SAID SE1/4, SE1/4; THENCE S03°12'30"W 1334.96 FEET TO THE SOUTHEAST CORNER OF THE SAID SE1/4, SE1/4; THENCE S03°34'31"W 208.71 FEET ALONG THE EAST LINE OF THE SAID NE1/4, NE1/4, SECTION 8; THENCE LEAVING THE SAID EAST LINE N88°36'38"W 208.71 FEET; THENCE N03°34'42"E 208.71 FEET TO THE NORTH LINE OF THE SAID NE1/4, NE1/4, SECTION 8; THENCE ALONG THE SAID NORTH LINE S88°36'28"E 153.70 FEET; THENCE LEAVING THE SAID NORTH LINE OF THE NE 1/4, NE 1/4, N35°02'49"W 1517.49 FEET; THENCE N62°38'06"E 105.00 FEET; THENCE N60°27'06"E 108.00 FEET; THENCE S89°07'54"E 814.00 FEET TO THE POINT OF BEGINNING CONTAINING 17.98 ACRES, MORE OR LESS. The City of Little Rock shall provide police and fire protection; and upon approval by the respective utility allow the property owners within the annexation to extend service lines to the Little Rock Water Reclamation System and Central Arkansas Water System from the effective date of the annexation. Section 3. That the zoning classification of the following described property be changed from I-1, Industrial Park District and Not Zoned to PID, Planned Industrial Development District: Z-9432: BEING A PART OF THE SE1/4, SE1/4, SECTION 5 AND ALSO ALL THAT PART OF THE NE1/4, SE1/4, SECTION 5 LYING SOUTH AND EAST OF THE CHICAGO - ROCK ISLAND - PACIFIC RAILROAD RIGHT-OF-WAY AND ALSO A PART OF THE NE 1 /4, NE1/4, SECTION 8 ALL IN T-1-S, R-12-W, PULASKI COUNTY, ARKANSAS, MORE PARTICULARLY DESCRIBED AS BEGINNING AT THE NORTHEAST CORNER OF THE SAID SE1/4, SE1/4; THENCE S03'12'30"W 1334.96 FEET TO THE SOUTHEAST CORNER OF THE SAID SE1/4, SE1/4; THENCE S03'34'31"W 208,71 FEET ALONG THE EAST LINE OF THE SAID NE1/4, NE1/4; THENCE LEAVING THE SAID EAST LINE N88'36'38"W 208.71 FEET; THENCE N03'34'42"E 208.71 FEET TO THE NORTH LINE OF THE SAID NE1/4, NE1/4, SECTION 8; THENCE ALONG THE SAID NORTH LINE S88"36"28"E 153.70 FEET; THENCE LEAVING THE SAID NORTH LINE N35'02'49"W 1517.49 FEET TO A POINTON THE SOUTHERLY RIGHT-OF-WAY LINE OF SAID RAILROAD; THENCE ALONG SAID RIGHT-OF-WAY N62'38'06"E 105.00 FEET; THENCE N60'27'06"E 108.00 FEET; THENCE ON A CURVE TO THE LEFT HAVING A LENGTH OF 483.57, RADIUS OF 5,752.61 FEET AND ACHORD N55'00"25"E 483.43 FEET; THENCE 434.44 FEET ALONG A CURVE TO THE LEFT WITH A RADIUS OF 4,482.29 FEET AND A CHORD N48'11'07"E 434.27 FEET TO THE INTERSECTION OF THE SOUTHERLY RIGHT-OF-WAY LINE AND THE EASTERLY RIGHT-OF-WAY LINE OF SAID RAILROAD; THENCE ALONG THE SAID EASTERLY RIGHT-OF-WAY LINE 396.38 FEET ALONG A CURVE TO THE LEFT HAVING A RADIUS OF 642.11 FEET AND ACHORD S05'20'12"E 396.38 FEET; THENCE S23'50'41"E 150.49 FEET TO THE EAST LINE OF THE SAID NE1/4, SE1/4, SECTION 5; THENCE LEAVING THE SAID EASTERLY RIGHT-OF-WAY LINE OF SAID RAILROAD S03'08'43"W 53,12 FEET TO THE POINT OF BEGINNING CONTAINING 22.70 ACRES, MORE OR LESS. Section 4. That the site development plan/plat be approved as recommended by the Little Rock Planning Commission. Section 5. That the zoning classification contemplated for AluChem PID, located at 10500 Arch Street Pike (Z-9432), is conditioned upon obtaining final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances. Section 6. That this ordinance shall not take effect and be in full force until the final plan approval. Section 7. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and Designated District Map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 9. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby repealed to the extent of such conflict.
