TRUSTEE'S NOTICE OF DEFAULT AND INTENTION TO SELL

WHEREAS, on April 17, 2000, Jason Phillips and Heather Phillips executed a deed of trust conveying certain property therein described to J. S. Brooks, as Trustee, in favor of First Financial Bank; and
WHEREAS, said deed of trust was duly recorded April 18, 2000, as Instrument No. 2000-6092 in the real estate records of Faulkner County, Arkansas; and
WHEREAS, default has occurred in the payment of said indebtedness and the same is now, therefore, wholly due, and the owner and holder of the debt has requested the undersigned to sell the property to satisfy said indebtedness; and
WHEREAS, there may be tenants that claim an interest in the real property herein based upon said tenancy.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that an agent of Wilson & Associates, P.L.L.C., as Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Trustee will, on March 2, 2010, at or about 2:30 P.M. at the Faulkner County Courthouse in Conway, Arkansas, offer for sale certain property hereinafter described to the highest bidder for cash, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the deed of trust, said property being real estate situated in Faulkner County, Arkansas, and being more particularly described as follows:
Lot 53, Indian Meadows Phase III, as shown on plat of record in Plat Book G, Page 60, records of Faulkner County, Arkansas.

UNLIKE JUDICIAL FORECLOSURE SALES, THIS STATUTORY FORECLOSURE SALE WILL BE HELD AT THE FRONT DOOR OF THE FAULKNER COUNTY COURTHOUSE OR, IF THERE IS NO AREA COMMONLY KNOWN AS THE FRONT DOOR, THEN THE SALE WILL BE HELD AT THE PLACE AT SAID VENUE WHERE FORECLOSURE SALES ARE CUSTOMARILY ADVERTISED AND CONDUCTED.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
The sale held pursuant to this Notice may be rescinded at the Trustee's option at any time.
