AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MAUMELLE, COUNTY OF PULASKI, STATE OF ARKANSAS, AN ORDINANCE TO BE TO BE ENTITLED: ORDINANCE NO. 1017.
AN ORDINANCE AMENDING THE MASTER STREET PLAN MAP FOR THE CITY OF MAUMELLE, ARKANSAS TO DOWNGRADE THE CLASSIFICATION OF A SPECIFIC SECTION OF PROPOSED MAUMELLE VALLEY DRIVE IN PHASE 19 OF MAUMELLE VALLEY ESTATES ADDITION FROM COLLECTOR TO A LOCAL STREET AND FOR OTHER PURPOSES.
WHEREAS, the City of Maumelle has previously adopted the Maumelle Master Street Plan which is comprised of certain code provisions and a map which has been reviewed, amended, and recommended for adoption by the Maumelle Planning Commission; and
WHEREAS, the Maumelle Planning Commission, in accordance with the authority granted by Maumelle Municipal Code Section 54-103, has recommended amending the Master Street plan from time to time; and
WHEREAS, on September 24, 2020, a majority of the members of the Planning Commission approved a motion to recommend that the City Council amend the Master Street Plan to downgrade the classification of a specific section of proposed Maumelle Valley Drive in Phase 19 of Maumelle Valley Estates Addition from Collector to a Local street with the recommendation that there is consideration given to providing sprinkling in residences on a grade greater than 12%; and
WHEREAS, the City Council has reviewed the recommendation of the Planning Commission and City Staff concerning amending the Master Street Plan and agrees to amend the Master Street Plan:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS:
SECTION 1. The MASTER STREET PLAN and Plan Map, which has been adopted in accordance with Maumelle Municipal Code Section 54-102, is hereby amended to downgrade a specific section of proposed Maumelle Valley Drive in Phase 19 of Maumelle Valley Estates Addition, specifically, the section beginning at the north boundary of lot 86 and ending at the south boundary of lot 99 on Maumelle Valley Drive, from the classification of Collector, to the classification of a Local street; said Plan Map is one of two parts of the Maumelle Master Street Plan.
SECTION 2. Repealer. All other ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict.
SECTION 3. Severability. If any clause, sentence, paragraph, section or other portion of this ordinance is found to be unconstitutional, invalid or inoperative by a court of competent jurisdiction, such findings shall not affect the validity of the remainder of these sections, nor shall any proceeding invalidating any portion of any section operate to affect any portion of the remainder of said sections not specifically attacked in said proceeding.
