On July 23, 2009, James C Gilliland and Amy N Cox executed a security instrument in favor of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Alacrity Lending Company, its successors and assigns; which was recorded August 17, 2009, Document No. 2009-15505 and re-recorded on October 29, 2009, Document No. 2009-20473, and modified on January 28, 2010, Document No. 2010-1591 in the real estate records of Faulkner County, Arkansas. A default has occurred due to the failure to make timely payments as required under the terms of the Note and indebtedness. Because of the failure to fully cure the default, the indebtedness was accelerated and is now wholly due.
