NOTICE OF APPLICATION AND COMPLAINT FOR CONDEMNATION AND FOR IMMEDIATE ENTRY

Markham, Little Rock, AR 72202, (501) 371-4717.  Notice is hereby given that an Application and Complaint for Condemnation and a Motion for Possession and for Immediate Entry Petition has been filed in the office of the Circuit Clerk of Pulaski County, Arkansas for Condemnation and for Immediate Entry in and to the following described property in Pulaski County, Arkansas, for a Temporary Construction Easement to wit: A tract of land for a Temporary Construction Easement located in Lot 152, Briarwood Addition to the City of Little Rock, Pulaski County Arkansas, being more particularly described as follows: A 7.00 foot wide Temporary Construction Easement parallel and adjacent to an existing 5.00 foot drainage easement along the northwestern property line of said lot 152 containing 505 sq. ft. more or less: The City is a municipal corporation organized and existing under the laws of the State of Arkansas. The Defendants are David Kaufman, Including Spouses, Heirs and Assigns, including all parties having an interest in the property located at 30 Flag Road, Pulaski County, Little Rock, AR 72205. The City desires a temporary easement for the purpose of grade tie ins and improving the existing ditch to a concrete line to help mitigate flooding issues that property owners are having.   Since the property owners within the area are experiencing flooding issues, and because the determination of questions in controversy in the proceeding will slow the construction improvements to the existing storm water drainage ditch, the City desires to deposit the sum of Three Hundred Dollars ($300.00) into the Court Registry. Wherefore, the City of Little Rock prays that the Court enter an order permitting it to enter and take immediate possession of the temporary construction easement described herein, approving and adjudicating the condemnation of the easement described herein for the purposes set forth above, providing that the easement so granted shall be deemed temporary and otherwise providing for a final hearing of this action to determine any further payment or compensation that may be due the property owner and for all proper relief.
