ORDINANCE NO. 22,237-AN ORDINANCE TO ABANDON THE ALLEY RIGHT-OF-WAY LOCATED WITHIN BLOCK 16, GILBRATER HEIGHTS ADDITION, BLOCK BOUNDED BY ATKINS ROAD TO THE EAST (700 BLOCK) AND THREE (3) UNDEVELOPED RIGHTS-OF-WAY TO THE NORTH, SOUTH AND WEST (G-23-486), IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

WHEREAS, the adjacent property owners request to abandon the ten (10)-foot wide alley right-of-way located within Block 16, Gilbralter Heights Addition, block bounded by Atkins Road to the east (700) block and three (3) undeveloped rights–of–way to the north, south and west; and, 

WHEREAS, the applicant requests the abandonment of ten (10)-foot wide alley right-of-way located with Block 16, Gilbralter Heights Addition. The block is bounded by Atkins Road to the east and three (3) undeveloped rights-of-way to the north, south, and west. The alley right-of-way is approximately 400 feet in length and ten (10) feet in width, or 0.092 acres. The alley right-of-way is currently undeveloped and mostly tree covered; and, 

WHEREAS, all of the abutting properties are zoned R-2, Single-Family District, and are comprised of sixteen (16) single-family lots. The alley right-of-way abandonment is requested in order to incorporate the area of abandonment into the adjacent lots for single-family residential development; and,

WHEREAS, the abandonment of this right-of-way will have no adverse impact on the public welfare and safety. The Little Rock Fire Department submitted no negative comments to the proposed abandonment request; and,

WHEREAS, the applicant submitted a letter from an abstract company stating that there are no reversionary clauses attached to the right-of-way requested for abandonment; and,

WHEREAS, all of the public utility companies have reviewed and approved the requested right-of-way abandonment; and,

WHEREAS, there are no Master Street Plan issues associated with this abandonment request, as the right-of-way is not classified as a collector street or higher;

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:

Section 1. The City of Little Rock, hereby releases, vacates, and abandons the following rights-of-way property located at the ten (10)-foot wide alley right-of-way located within Block 16, Gilbralter Heights Addition, block bounded by Atkins Road to the east (700) block and three (3) undeveloped rights-of-way to the north, south and west. The block is bounded by Atkins Road to the east and three (3) undeveloped rights-of-way to the north, south, and west. The alley right-of-way is approximately 400 feet in length and ten (10) feet in width, or 0.092 acres. 

Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate Records of the Recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas. 

Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance.

Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
