ORDINANCE NO. 22,238-AN ORDINANCE TO ABANDON THE ALLEY RIGHT-OF-WAY LOCATED WITHIN BLOCK 176, ORIGINAL CITY OF LITTLE ROCK, BLOCK BOUNDED BY WEST 7TH STREET, WEST 8TH STREET, STATE STREET AND SOUTH GAINES STREET (G-23-487), IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.

WHEREAS, the adjacent property owners request to abandon the north 160 feet of the twenty (20)-foot wide alley right-of-way located within Block 176, Original City of Little Rock, block bounded by West 7th Street to the north, West 8th Street to the south, South State Street to the west and South Gaines Street to the east; and, 

WHEREAS, the portion of the alley right-of-way proposed for abandonment lies under an existing two (2)-story commercial building located at 711/717 West 8th Street. The south portion of the alley right-of-way, which is not being proposed for abandonment, serves as a service drive area for garbage pick-up; and, 

WHEREAS, the abandonment of this right-of-way will have no adverse impact on the public welfare and safety. The Little Rock Fire Department submitted no negative comments to the proposed abandonment request; and, 

WHEREAS, the applicant submitted a letter from an abstract company states that the reversionary rights rest in the City of Little Rock; and,

WHEREAS, all of the public utility companies have reviewed and approved the requested right-of-way abandonment; and,

WHEREAS, there are no Master Street Plan issues associated with this abandonment request, as the right-of-way is not classified as a collector street or higher.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:

Section 1. The City of Little Rock, hereby releases, vacates and abandons the following rights-of-way property located within the north 160 feet of the twenty (20)-foot wide alley right-of-way, located within Block 176, Original City of Little Rock, block bounded by West 7th Street to the north, West 8th Street to the south, South State Street to the west and South Gaines Street to the east.

Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate Records of the Recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas. 

Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance.

Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
